Dreaming is often characterized as lacking high-order cognitive skills. In two studies, we test the alternative hypothesis that the dreaming mind is highly similar to the waking mind. Multiple experience samples were obtained from late-night REM sleep and waking, following a systematic protocol described in Kahan . Results indicated that reported dreaming and waking experiences are surprisingly similar in their cognitive and sensory qualities. Concurrently, ratings of dreaming and waking experiences were markedly different on questions of general reality orientation and (...) logical organization . Consistent with other recent studies , experiences sampled from dreaming and waking were more similar with respect to their process features than with respect to their structural features. (shrink)

You can't be convicted of a crime without a guilty act and a guilty mind." A lawyer might dress the same idea up in Latin: "You can't be convicted of a crime without actus reus and mens rea." Things like that are often said, but what do people mean when they say them? Guilty Acts, Guilty Minds proposes an understanding of mens rea and actus reus as limits on the authority of a state, and in particular the authority of a (...) democratic state, to ascribe guilt through positive law to those accused of crime. Actus reus and mens rea are necessary conditions, among others, for the legitimacy, as distinct from the justice, of state punishment. The actus reus requirement disables a democratic state from using its authority, on the one hand, to ascribe guilt to those who didn't realize they were committing a crime, provided they lacked the capacity to realize they were committing a crime; and on the other, to ascribe guilt to those who realized they were committing a crime, but who lacked the capacity to conform their conduct to the requirements of law. The mens rea requirement disables a democratic state from using its authority, on the one hand, to ascribe guilt to those who didn't realize they were committing a crime, provided their ignorance manifested no lack of law-abiding concern for the law and its ends, and on the other, to ascribe guilt to those who realized they were committing a crime, but whose failure to conform to the law nonetheless manifested no lack of law-abiding concern for the law and its ends. In a recent paper, Joshua Knobe (2019) offers a startling account of the metaphilosophical implications of findings in experimental philosophy. We argue that Knobe’s account is seriously mistaken, and that it is based on a radically misleading portrait of recent work in experimental philosophy and cultural psychology.

From Descartes to Popper, philosophers have criticized and tried to improve the strategies of reasoning invoked in science and in everyday life. In recent years leading cognitive psychologists have painted a detailed, controversial, and highly critical portrait of common sense reasoning. Stephen Stich begins with a spirited defense of this work and a critique of those writers who argue that widespread irrationality is a biological or conceptual impossibility.Stich then explores the nature of rationality and irrationality: What is it that (...) distinguishes good reasoning from bad? He rejects the most widely accepted approaches to this question approaches which unpack rationality by appeal to truth, to reflective equilibrium or conceptual analysis. The alternative he defends grows out of the pragmatic tradition in which reasoning is viewed as a cognitive tool. Stich's version of pragmatism leads to a radical epistemic relativism and he argues that the widespread abhorrence of relativism is ill founded. (shrink)

Diseases causing inherited retinal degeneration in humans, such as retinitis pigmentosa and macular dystrophy, are genetically heterogeneous and clinically diverse. More than 40 genes causing retinal degeneration have been mapped to specific chromosomal sites; of these, at least 10 have been cloned and characterized. Mutations in two proteins, rhodopsin and peripherin/RDS, account for approximately 35% of all cases of autosomal dominant retinitis pigmentosa and a lesser fraction of other retinal conditions. This target article reviews the genes and mutations causing retinal (...) degeneration and proposes mechanisms whereby specific mutations lead to particular clinical consequences, that is, the relationship between genotype and phenotype. Retinitis pigmentosa and macular dystrophy are genetically heterogeneous diseases that cause retinal degeneration in humans and often result in severe visual impairment or blindness. Although many of the genes causing these diseases have not been identified, three photoreceptor-specific proteins have been implicated: rhodopsin, peripherin/RDS, and the P-subunit of rod phosphodiesterase. Mutations in the genes for these three proteins can cause either dominant retinitis pigmentosa, recessive retinitis pigmentosa, dominant congenital stationary night blindness, or dominant macular degeneration. Why this multiplicity of clinical phenotypes? Our target article summarizes the genetic and biochemical background to this question and proposes a number of possible explanations. Discussion focuses mainly on 73 distinct disease-causing mutations of rhodopsin. We feel that rhodopsin and other photoreceptor proteins can serve as model systems for unraveling the connection between genotype and phenotype, not only for inherited retinal diseases but for other degenerative disorders as well. Publishing is changing rapidly, though these changes are concealed from academics, who are presented the appearances of the old world of print. The economic incentives and consequently the strategies of publishers have, however, changed. Where quality was once the road to profit, content now is, and novel digital delivery systems are the key to sales. Academic libraries have become storefronts for digital sales. Editors have become content collectors. At the same time publishing has attempted to mimic the accessibility of the (...) web, shrinking the gap between “publication” and posting. This raises the question of what value is added by journal publication, and whether there is a justification for the huge cost. Some shorter and longer term perspectives suggest that the current value-added is linked to policies of evaluation, but that these may change. (shrink)

In this book, Stich unravels - or deconstructs - the doctrine called "eliminativism". Eliminativism claims that beliefs, desires, and many other mental states we use to describe the mind do not exist, but are fiction posits of a badly mistaken theory of "folk psychology". Stich makes a u-turn in his book, opening up new and controversial positions.

Normativity is what gives reasons their force, makes words meaningful, and makes rules and laws binding. It is present whenever we use such terms as ‘correct,' ‘ought,' ‘must,' and the language of obligation, responsibility, and logical compulsion. Yet normativists, the philosophers committed to this idea, admit that the idea of a non-causal normative realm and a body of normative objects is spooky. Explaining the Normative is the first systematic, historically grounded critique of normativism. It identifies the standard normativist pattern of (...) argument, and shows how this pattern depends on circularities, assumptions about the unique correctness of preferred descriptions, problematic transcendental arguments, and regress arguments that end in mysteries. The book considers in detail a paradigm case: legal normativity as constructed by Hans Kelsen. This case exemplifies the problems with normativist arguments. But it also shows how normativism was constructed as an alternative to ordinary social science explanation. The normativist argument is that social science explanations themselves are forced to rely on normative conceptsÑminimally, on normative rationality and on a normative view of ‘concepts' themselves. Empathic understanding of the reasoning and meanings of others, however, can solve the regress problems about meaning and rationality that are central to the appeal of normativism. This account has no need for a parallel normative world, and has a surprising and revealing lineage in the history of philosophy, as well as a basis in neuroscience. (shrink)

The lack of "progress" in theory is often contrasted to progress in statistical methodology. The relation between the two bodies of thinking is itself problematic, however, for the particular advances in method that have occurred in quantitative sociology reflect a trade-off in which the results are characterized by the radical underdetermination of models by data and a high level of slack between measures and theoretical concepts. Both of these problems are usually understood as matters of "error," and thus as potentially (...) eliminable, but this claim is highly questionable, on grounds evident from Pearson's philosophy of science. The implications of large ineliminable error for the project of theory construction, particularly the "formal theory" of Blau and the California Positivists, is discussed. The ease of producing statistical results is an achievement, but one that leads away from theory rather than toward it, and, because the fact of underdetermination prevents these results from establishing clear cognitive superiority over the results of other "approaches," theoretical diversity is, in a sense, a consequence of the properties of the dominant statistical tradition in sociology. The exercise of synchronic self-control is the way in which an actor can attempt to bring a desire into alignment with his better judgement at the moment and during the interval of time over which, but for the exercise of such self-control, the desire would become the actor’s preponderant desire, which the actor would then translate into an act contrary to his better judgment. The moral psychology of an actor who fails to achieve such self-control can be analyzed in two (...) ways. One way is meant to be consistent with compatibilist metaphysics; the other with libertarian metaphysics. The implications of these analyses for the criminal law are complicated, but perhaps the most important is this: the criminal law should in principle recognize a partial excuse for an actor who exercises synchronic self-control but who gives up his effort because he believes that he can no longer continue to resist. His effort to achieve self-control thus fails, and he ends up translating into action the very desire he set out to control. (shrink)

This short review examines the work of four Canadian scholars addressing a variety of questions about criminal responsibility. The essays under review are a small part of a recent collection of essays entitled “Rethinking Criminal Law Theory: New Canadian Perspectives in the Philosophy of Domestic, Transnational, and International Criminal Law.”.

The World Wide Web is often touted as a way to distribute expertise, thus decentering knowledge creation and dissemination. However, conceptualizing ex pertise as multiple does not sufficiently problematize the unitary expertise model that considers expertise as something held by someone (the "expert") and trans ferred to someone else (the "novice "). The author makes the claim that expertise has been primarily theorized by various psychologicalframeworks; these ways of conceptualizing expertise are largely ignorant of the ways that they position the (...) student as a passive receptor of knowledge and do not fully allow for the problematization of the nature of knowledge. Recon ceptualizing expertise then would require movingfrom a narrowly construed psychological conception of ex pertise to a notion of expertise more sociological in character. This article explores conceptualizations of expertise within some dominant psychological frame works. The author explores how the new information technologies compel a reexamination of these notions of expertise. (shrink)

Imagine a citizen (call her Ellen) engages in conduct the state says is a crime, for example, money laundering. Imagine too that the state of which Ellen is a citizen has decided to make money laundering a crime. Does the state wrong Ellen when it punishes her for money laundering? It depends on what you think about the authority of the criminal law. Most criminal law scholars would probably say that the criminal law as such has no authority. Whatever authority (...) is has depends on how well it adheres to the demands of morality inasmuch as morality is the only authority we have. Thus if morality says that money laundering should not be a crime then the state wrongs Ellen when it punishes her. But if the criminal law as such does have authority, and if in the exercise of its authority the state has decided to make money laundering a crime, then the state does Ellen no wrong when it punishes her. Recent findings emphasize the complexity, both genetic and functional, of the manifold genes and mutations causing inherited retinal degeneration in humans. Knowledge of the genetic bases of these diseases can contribute to design of rational therapy, as well as elucidating the function of each gene product in normal visual processes.

Joseph LaPorte in an article on `Kind and Rigidity'(Philosophical Studies, Volume 97) resurrects an oldsolution to the problem of how to understand the rigidityof kind terms and other general terms. Despite LaPorte'sarguments to the contrary, his solution trivializes thenotion of rigidity when applied to general terms. Hisarguments do lead to an important insight however. Thenotions of rigidity and non-rigidity do not usefullyapply at all to kind or other general terms. Extendingthe notion of rigidity from singular terms such as propernames to (...) general terms such as natural kind terms is amistake. (shrink)

Although less observable than the overt actions of fighting and assault, covert antisocial behaviors such as stealing and property destruction comprise an important subclass of externalizing behavior patterns, displaying considerable predictive power toward delinquency in adolescence. I discuss a laboratory paradigm for objective observation of such behaviors in children that has shown impressive concurrent and predictive validity among samples of boys with and without attention deficit hyperactivity disorder. Addressed herein are crucial questions regarding the ethics of tempting children to steal (...) objects and small amounts of money and to deface property as well as the types of informed consent and debriefing procedures utilized in research with this paradigm. Weighing ethical considerations alongside the ability to predict delinquent behavior presents provocative issues for those interested in understanding the development of antisocial behavior. I will contend that Quine's optimism about the theory of reference is incompatible with his pessimism about the theory of meaning. For, on Quine's own account, the problems that discourage him about the theory of meaning beset the theory of reference as well. And of the three arguments Quine advances to show the theory of reference better off than the theory of meaning, two are unsound and the third is in conflict with his further views on reference.
